Dear Ms. Haag,
I write to point out to you a serious violation of the law within your jurisdiction; namely the publication in today’s
San José
Mercury News (page A9) of a cartoon inciting violence against a head of state, President of Syria Bashar al-Asad.
A copy of this cartoon is attached for your perusal and reference.
The applicable law was summed
up by the United States Court of Appeals for the 2nd Circuit in the US Government’s case against the “Blind
Sheikh,” Omar Abdur Rahman, where Judges Newman, Leval and Parker wrote: “Words of this nature
– ones that instruct, solicit or persuade others to commit crimes of violence – violate the law and may be properly
prosecuted regardless of whether they are uttered in private, or in a public speech, or in administering the duties of a religious
ministry.” If a picture is worth a thousand words, then a cartoon is certainly worth a million words
or more when it is published in newspapers across this nation and circulated around the globe. The effect
is a high-tech lynching.
Now that I have informed you of this violation of the law just hours ago in your
jurisdiction, and have given to you a reference to the applicable law, I ask that you take proper action against the editors
of the San José Mercury News, the cartoonist and his employer, the Washington Post, and the syndicate that promoted
publication of this call to violence.
What is at stake here is the rule of law and the equal applicability
of the law. Even if you believe our government’s propaganda processed through the news media (I certainly
don’t believe it!), there is no excuse for open and egregious violation of the law. When this happens,
an atmosphere for lynching is created, and a law of the jungle prevails, which not only tarnishes our nation’s image
abroad, but puts all of us in great danger. What goes around comes around.
